There is an attempt by the government to hand over all the powers of the ‘Constitutional Council’ to be established by the 17th amendment to the President reports today’s ‘Lakbima.’
According to ‘Lakbima’ the government is considering amending clauses in the 17th amendment regarding the ‘Constitutional Council’ so that the representative to be appointed by the President to this body with the agreement of the Prime Minister, the Speaker and the Leader of the Opposition would be done without their consent but solely at the discretion of the President.
The clauses regarding the appointment of representatives to the ‘Constitutional Council’ states that representatives to it are appointed with the consent of all political parties that represent the Parliament so that the independency of the ‘Constitutional Council’ would be protected. It is believed that when the ‘Constitutional Council’ is independent the commissions such as Public Services, Police and Election Commissions appointed through it would be independent.
However, after Mr. Mahinda Rajapakse came to power representatives for the ‘Constitutional Council’ were not named. As such it is not functional and the government is accused of manipulating the public service, police as well as elections according to the wishes of the government. Specially, there is no way of taking action regarding political revenge that is rampant in public service, transfers, illegal appointments, police atrocities and political interferences, frauds, corruption and political appointments.
