A Judge visiting a person sentenced to the gallows is a violation of professional ethics states Lawyers for Democracy in Sri Lanka.
The co-convener of the organization Attorney-at-Law Chandrapala Kumarage said this speaking to BBC Sinhala Service regarding a female Judge’s visit to former Parliamentarian Duminda Silva who has been sentenced to death.
The spokesman for the Prisons Department Thushara Upuldeniya has confirmed to BBC that the female Judge had met Duminda Silva when she visited the prison for a hearing. He said reports that state the Judge had met Duminda Silva after prisoners’ visiting hours are not correct.
The spokesman said the Judge had not met Duminda Silva at night though the media states so. He said the Judge met him at about 2.00 p.m.
Attorney-at-Law Chandrapala Kumarage has said any legal officer visiting a person who has been sentenced to death is contrary to the ethics of Judges. He said the Judge’s visit cannot be endorsed as Duminda Silva has appealed against the sentence.
If prison officials had given permission to visit prisoners after visiting hours the prison officials as well as the visitor have violated the law said Attorney-at-Law Chandrapala Kumarage.
